China Expands Its Exit Ban Powers

China has implemented sweeping new border regulations giving authorities expanded power to prevent citizens from leaving the country over national-security and technology-related violations. Under the rules, Chinese citizens who engage in illegal or criminal activity overseas that authorities determine endangered national security can face exit bans lasting from six months to three years after returning home. Citizens who violate technology export or import regulations in ways deemed harmful to China’s industrial or technological security can also be prevented from leaving. Perhaps most strikingly, although authorities ordinarily must provide written notice explaining an exit ban, that notification can be withheld when officials determine disclosure could affect national security or a criminal investigation. Chinese authorities say the measures are intended to protect national sovereignty and security, prevent illegal transfers of sensitive technology, and address cross-border criminal activity—not restrict legitimate travel by ordinary citizens.


The changes come as Beijing increasingly treats technology, information, and human mobility as national-security concerns. The regulations arrive amid fierce competition with the United States over artificial intelligence and other emerging technologies, and China has already demonstrated its willingness to restrict movement when sensitive technology is involved. Earlier this year, authorities reportedly barred co-founders of the Chinese-founded AI company Manus from leaving China amid government concerns surrounding its proposed acquisition by Meta. Critics worry that broad terms such as “national interests” and “technology security” could provide officials significant discretion in deciding who falls under the new rules. Human Rights Watch argues that the decree expands the potential for arbitrary exit bans, while China maintains that the regulations strengthen legal safeguards and target unlawful behavior rather than normal international travel. Whatever the debate over their application, the underlying mechanism is unmistakable: a person can possess a passport, arrive at the border, and still discover that the state has decided he is not authorized to leave.
