EU Forces Poland to Honor Same-Sex Marriages

In a landmark ruling that highlights the growing ideological divide across Europe, the EU’s top court has ordered Poland to recognize same-sex marriages performed elsewhere in the European Union—even though Polish law does not recognize such unions. The case centered on a Polish couple who married in Berlin in 2018 and later moved back to Poland, where authorities refused to acknowledge their marriage certificate. The European Court of Justice ruled that while marriage laws remain a national matter, EU freedom-of-movement rights supersede domestic policies. In essence, any same-sex marriage “lawfully concluded” in one EU country must be treated as valid across all member states. The ruling does not force Poland to legalize same-sex marriage internally, but it does require the country to recognize these unions for any EU citizens returning home.
