
France has crossed a historic threshold after the country's Constitutional Council upheld legislation legalizing medically assisted dying under specified circumstances. The law survived multiple constitutional challenges after France's National Assembly approved it on July 15 by a vote of 291–241, overcoming previous opposition in the Senate. Under the legislation, eligible adults must be French citizens or long-term residents and suffer from a serious and incurable illness producing unbearable or treatment-resistant suffering. The process can culminate in the administration of a lethal substance, either by the patient or, when physically unable, with assistance from a medical professional. The Constitutional Council ruled that the framework is compatible with constitutional principles of human dignity and personal freedom.
The ruling also addressed concerns surrounding doctors, pharmacists, caregivers, and institutions that object to participating. The Council strengthened conscience protections by clarifying that pharmacists may refuse to prepare the lethal substance and that private or religious institutions may prohibit assisted dying on their premises. Yet the larger cultural shift remains unmistakable. France resisted legalization for years even as neighboring countries moved in that direction, but President Emmanuel Macron eventually threw his support behind what he described as "help to die." What was once legally prohibited has now been reframed as an individual right under carefully defined conditions. The debate has therefore moved beyond whether physicians should be permitted to intentionally assist in ending life to determining the circumstances, safeguards, and procedures under which the state will allow them to do so.
