Kenya’s Court of Appeal has ruled that abortion is not a fundamental constitutional right, delivering a major legal decision that reaffirmed protections for unborn children. The three-judge panel overturned a 2022 High Court ruling that had expanded abortion access and instead declared that Kenya’s constitution expressly prohibits abortion except in limited circumstances. Judges pointed to Article 26 of the 2010 constitution, which states that the right to life begins at conception.
Under the ruling, abortion remains permitted only in narrow cases where a trained medical professional determines the mother’s life or health is at risk, or where emergency treatment is required. The court also revived criminal proceedings tied to a 2019 abortion case involving serious complications suffered by a teenage girl. By restoring the original cases, the judges reinforced that unlawful abortions outside constitutional exceptions can still face criminal penalties under Kenyan law.
The decision was praised by pro-life advocates and many Christians across Kenya, while abortion-rights groups vowed to appeal to the Supreme Court. Kenya remains a nation where Christian values continue to hold strong cultural influence, even amid global pressure to liberalize abortion laws. This ruling stands out in an era when many nations move further from biblical principles. At a time when life is often devalued, a court declaring protection for the unborn is a reminder that the battle between truth and moral rebellion is still being fought in the public square.
