Spain Bill Could Jail Pastors for Counseling

A proposed amendment in Spain is causing significant concern among Christian communities, particularly the Spanish Evangelical Alliance (AEE), as it could criminalize pastors and others who offer support to individuals struggling with same-sex attraction or gender identity. On June 24, Spain’s Congress of Deputies approved a preliminary bill with overwhelming support—311 votes in favor, 33 against, and one abstention—that would amend Article 10/1995 of the Penal Code. The legislation aims to penalize so-called “conversion therapies” that seek to modify or deny an individual’s sexual orientation or gender expression, including through psychological or pastoral care. If passed, those found guilty could face prison terms of six months to two years, with even harsher penalties if the person is a minor or if coercion, profit, or association with an organized group is involved.


The AEE has pushed back strongly, accusing lawmakers of misrepresenting supportive and voluntary pastoral care as manipulative or abusive. In a formal statement, the AEE criticized the use of pejorative language like “conversion therapy,” which they argue falsely implies coercion and torture—both of which are already criminalized under existing law. They emphasized that pastoral care or therapeutic support offered to individuals seeking alignment between their biological sex and gender identity is based on informed consent and has nothing to do with forceful intervention. The AEE warned that this bill poses a serious threat to religious freedom and the ability of individuals to seek help on their own terms, calling on legislators to reconsider the real-life implications for people of faith and the professionals who serve them.
