
A new bipartisan proposal in Congress known as the KIDS Act is being promoted as legislation designed to protect children online, but it could dramatically expand digital surveillance and further erode online anonymity. The massive bill combines multiple internet safety measures and would require social media companies, gaming platforms, and AI services to provide enhanced protections for minors. However, the legislation places companies in a difficult position by holding them responsible for users they "know or should have known" are underage. While the bill claims that age verification is not mandatory, many privacy advocates argue that platforms will have little choice but to collect more personal information to shield themselves from legal liability.
The practical result could be an internet increasingly built around identity verification, age estimation technologies, and expanded data collection. Companies may be forced to implement digital identification systems, biometric analysis, or artificial intelligence tools capable of determining the age of users before granting access to online services. State governments would also be permitted to enact even stricter regulations, potentially creating a patchwork of laws that further pressure companies to eliminate anonymous participation online. Although the legislation contains language protecting encryption, critics warn that compliance requirements could indirectly encourage greater monitoring of user activity and behavior.
